1. YES
2. Your employer not only should not revoke your I140 but should not be using the LC for someone else. If he chooses use it for some one else the originla beneficiary will no longer get its benefits.
3. The condition for three years extension is you are not able to get to I485 because of retrogression so they will give you three years,
It is possible with a different employer only if the new LC and I140 is approved and you are waiting to file I485.
This is what I know, but I am not an attorney so better to talk to your (new) company attorney before making the move.

How will you do that? I guess, while working on cases, user has to click somewhere to send an email. If they choose not to, then there will be no email. In my case, I never saw consistency in getting emails. I don't think that is a big issue, just check your status periodically. Bigger and important issue is how to get your case processed faster, and in sequence.
USCIS online case status system broken, My AP receipt numbers are not showing up online. we need to alert concerned USCIS authorities directly or thru IV's contacts in USCIS or thru AILA.

Interesting comment on one of old BusinessWeek articles. It strongly highlights power an employer holds over H1-B employee.
http://www.businessweek.com/globalbiz/blog/bangaloretigers/archives/2006/11/us_software_tal.html
"'m not at all surprised that the first few comments on this post have been very skeptical of the skills shortage.
No matter how you feel about the alleged shortage, you have to acknowledge that the H1B gives the employer a remarkable amount of power over the employee's life. The employer bestows the right to live in the United States upon the employee, and often sponsers the employee's application for a green card. Changing employers is not impossible, but it is tricky and perilous.
As an American, I can quit my job and become a contractor. An H1B can't. If my girlfriend decides to move across the country for a new job, I can quit my old job and go with her. An H1B can't. If I decide I'm tired of programming, I can quit and apply to law school. An H1B can't. And, most importantly, if I think I'm talented and should earn well above market rate, I can go into my boss's office and negotiate with the knowledge that I'm free to find a better deal elsewhere. An H1B can't - unless, of course, he's willing to give up on his wait for a green card and return to his country of origin and start all over again.
While I'm not a protectionist in any way, I view the indenturedness of the H1B visa as an affront to everything America claims it believes about human and economic freedoms. No employer should ever have this kind of power over an employee.
Congress is perfectly capably of creating an employment category for foreign nationals that preserves freedom for the engineer who comes to America. They still haven't. Why? Well, the most likely explanation is that the corporations who lobby for this visa *enjoy* this power over engineers. And this, in turn, leads to work conditions that drive America's best and brightest away, into careers in law, medicine, finance, and so forth, exacerbating the very shortage that the visa was designed to address.
Unlike some of the posters here, I'm ok with the existence of skilled worker visas. But any increase should be off the table until basic human and economic freedoms are preserved for the worker. In America, you have the right to quit your job. Period. "

 But the dates having moved beyond the April 2000 deadline ( may be temporarily), why should they not move fast when the VB was current for a long time and there should not be many cases after April 2000 those were not adjudicated. So I feel if the dates don't retrogress then they should move forward faster.

Thanks GC check!
Yes I am using EAD and AC21 for joining new employer and job title and responsibilities are very similar.
Can I hire a new attorney who can access that information? Or the new company attorney? I think it's going to be impossible to make my present company attorney reveal that detail to me. Since this information is public I think there should be some way to get those details. Please help.

I am hoping someone can shed some light on this situation:
I filed 140 and 485 concurrently (July, 2007). Today I received an email update saying that a RFE has been sent about my 485 petition. There's a LUD update for my 485 but my 140 seems untouched. What kind of issues with the case would prompt an RFE for the 485 before the 140 is processed? Is this for a second set of fingerprints or could this be something more serious? Thanks in advance for your responses.
Any issue with Birth Certificate, Marriage Certificate (if you are a dependent), Medical report & etc could trigger an RFE.
May be your 140 is approvable & 485 will be approved as soon as you reply to the RFE.
I have seen other posts in this forum where people have reported that they received both 485 and 140 approvals together.
Whatever the RFE is, reply to it ASAP and you should be lucky enough to get your GC before the dates change.
Good luck.

I recently got my EB1 I-140 approved. Now my lawyer wants to apply for the I-485 but I am unemployed currently. What are my options in this case? Do I show I am self-employed and apply the I-485 or wait till I get a job.
Just as a background I already have a EB2 Employer based I-485 in process and therefore have the EAD and AP in hand. The EB2 I-485 was applied in 2007 so it is past the 180 days period.
Urgent help will be greatly appreciated.

As far as I know, since you are past 180 days of 485 filing, you are ok. You can stay in the country based on your pending 485 application. You can take whatever time it takes for you to get a job in your same/similar job classification. However, if your 485 is close to approval, then you need to hurry to find the job, since a job offer is required at the time of adjudication of 485. This will depend on your country of chargeability and PD. If you are from India/china/philippines/mexico with a later PD, you should be ok as long as you find a job in the same or similar classification.

I live in New jersey and send my EAD renewal to Nebraska based on my I-485. When i read the instructions, I found out that the application has to go to Texas based to the state where i am in now.
I would appreciate if anyone had same experience and share it with us.
Thank you

Hi folks,
Have a question? Will it be possible to change from EB-2 to Eb-3 with in the same company. My PD is Nov 02 with I-140 just now approved. Or do i have to find another job in some other company in order to use old priority date. Pl. advise is this the right time to change or wait for EB-3 to be current for my PD(don't know , lost hope as of now)
Thanks
Yes, it is possible if you qualify for eb2 in the same company, lawyers can help you with it if you qualify.

If you are in an apartment complex that offers cash bonus for referrals, ask the manager to apply it towards the rent and not give you a bonus. That way, it is not counted as income but a reduction in rent for the next month and avoids all taxation issues crap.

Any attorneys opinion? or people who were in similar situation?
remember, it's not my entire company being sold to another company. Only a fraction of company( a division) is being sold along with the assets( people, stuff etc).

My Indian passport is going to expire very soon and my visa has also expired.
I have applied for extension for 3 years.
Will I face any problems in getting new passport from Indian Embassy?
Has anybody done that before?
I am sorry if this is not right place to write about it...
thanks
you can get your passport renewed by sending it to the Indian Embassy in the US immediately. I don't know about your visa. Talk to your lawyer. But why did you let your visa expire? That I am sure you know IS ILLEGAL.
